Dubai sees improved personal finance and jobs fuelling consumer ...

Positive sentiment guiding consumer behaviour and planning was largely visible across Dubai during the July-September 2012 period. Overall consumer confidence recorded in Dubai during the third quarter was 129, well above the average of 100 and seven points higher than Q2 2012.

CCI recorded in the third quarter of 2012 is the highest since the corresponding quarter of the previous year. A growing confidence on personal finances is among the highlights of the third quarter index. Nearly 77% of the consumers sounded positive on their current financial situation and 86% have a brighter outlook for the next 12 months.

Consumer perceptions on Dubai's economy has also shown remarkable improvement in Q3 2012 with 66% people expressing positive sentiment on the current state of economy as against 55% in the second quarter. Dubai's economy is also set to improve in the next 12 months, according to 84% of the respondents.

Two-third of the consumers rated job prospects during the third quarter as very good even when job security and the state of the economy remained the topmost concerns for most of them. Business owners are more positive on jobs, thus giving job seekers stronger reasons for optimism.

"Consumer confidence is a clear indicator of the perceptions on the state of the economy and its key drivers. As recent surveys indicate, Dubai is witnessing rising confidence among consumers, which is clearly reflected on spending patterns and future planning," said His Excellency Sami Al Qamzi, Director General of DED.

The Consumer Confidence Index is based on responses to three questions regarding perceptions of local job prospects, personal finances and whether it is good to buy things that people need and want, all over the next 12 months. Responses vary from Excellent or Good to Not so good or Bad.

Conducted in each quarter, the survey gathers feedbacks from 2,000 respondents, equally divided between the four quarters of the year. The respondents are all Dubai residents and cover males and females as well as nationals and expatriates, in the 20-59 age group.

"The responses in the survey help understand where the local market is headed and to what extent consumers are willing to spend or save. As a result businesses and development planners are able to prepare well for the future and avoid negative market implications," added Al Qamzi.

Consumer behaviour over the third quarter also shows a more prudent and careful approach. The percentage of consumers spending on holidays, outdoor entertainment, new technology products, home make-over or in paying off debts, including credit cards and loans, showed a decline compared to the second quarter. Meanwhile, 4% more consumers started putting their money in to savings in the third quarter compared to the previous quarter.

Compound in grapes, red wine could be key to fighting prostate cancer

ScienceDaily (Nov. 9, 2012) ? Resveratrol, a compound found commonly in grape skins and red wine, has been shown to have several beneficial effects on human health, including cardiovascular health and stroke prevention. Now, a University of Missouri researcher has discovered that the compound can make prostate tumor cells more susceptible to radiation treatment, increasing the chances of a full recovery from all types of prostate cancer, including aggressive tumors.

"Other studies have noted that resveratrol made tumor cells more susceptible to chemotherapy, and we wanted to see if it had the same effect for radiation therapy," said Michael Nicholl, an assistant professor of surgical oncology in the MU School of Medicine. "We found that when exposed to the compound, the tumor cells were more susceptible to radiation treatment, but that the effect was greater than just treating with both compounds separately."

Prostate tumor cells contain very low levels of two proteins, perforin and granzyme B, which can function together to kill cells. However, both proteins need to be highly "expressed" to kill tumor cells. In his study, when Nicholl introduced resveratrol into the prostate tumor cells, the activity of the two proteins increased greatly. Following radiation treatment, Nicholl found that up to 97 percent of the tumor cells died, which is a much higher percentage than treatment with radiation alone.

"It is critical that both proteins, perforin and granzyme B, are present in order to kill the tumor cells, and we found that the resveratrol helped to increase their activity in prostate tumor cells," Nicholl said. "Following the resveratrol-radiation treatment, we realized that we were able to kill many more tumor cells when compared with treating the tumor with radiation alone. It's important to note that this killed all types of prostate tumor cells, including aggressive tumor cells."

Resveratrol is present in grape skins and red wine and available over-the-counter in many health food sections at grocery stores. However, the dosage needed to have an effect on tumor cells is so great that many people would experience uncomfortable side effects.

"We don't need a large dose at the site of the tumor, but the body processes this compound so efficiently that a person needs to ingest a lot of resveratrol to make sure enough of it ends up at the tumor site. Because of that challenge, we have to look at different delivery methods for this compound to be effective," Nicholl said. "It's very attractive as a therapeutic agent since it is a natural compound and something that most of us have consumed in our lifetimes."

Nicholl said that the next step would be to test the procedure in an animal model before any clinical trials can be initiated. Nicholl's studies were published in the Journal of Andrology and Cancer Science. The early-stage results of this research are promising. If additional studies, including animal studies, are successful within the next few years, MU officials will request authority from the federal government to begin human drug development (this is commonly referred to as the "investigative new drug" status). After this status has been granted, researchers may conduct human clinical trials with the hope of developing new treatments for cancer.

Insight: California Democrats amass control over unruly state

SAN FRANCISCO (Reuters) - California just became a one-party state.

Governor Jerry Brown and his Democratic allies on Tuesday won a mandate that might be the envy of President Barack Obama, turning the nation's bluest state into one in which Democrats will likely have all but complete political control.

Voters approved a tax hike championed by Brown and soundly rejected a measure that would have gutted union political power. Perhaps most importantly, if initial vote totals hold in several very close legislative races as the final absentee ballots are counted, they will have handed Democrats supermajority control of both houses of the state legislature for the first time in 79 years.

Brown, who largely failed to gain cooperation from Republicans over the last two years, now owns the field. He has the opportunity to overhaul the tax code, reform the Byzantine governmental processes that have hobbled Sacramento for decades, and even potentially touch the "third rail" of California politics, the low-property-tax measure known as Proposition 13.

"I guess you might say it's our time," Senate President Pro Tem Darrell Steinberg told a news conference.

The ascendance of Democrats and their union backers may give more than a little pause to businesses and wealthy individuals, who now face higher taxes and the prospect of even more new taxes and regulations.

The state's top personal income tax rate was already the second highest in the nation at 10.3 percent before Tuesday's vote, and will now rise to 13.3 percent for the next seven years.

"Enabling the tax-and-spend majority in the capital to have carte blanche to heap new and unanticipated taxes on already struggling Californians gives us extraordinary concern," said John Kabateck, California executive director of the National Federation of Independent Businesses.

Brown was quick to acknowledge the need for restraint. The former seminarian cited the Biblical story of Joseph and the pharaoh at a news conference Wednesday, in which Joseph told the pharaoh to prepare for lean years in times of plenty.

"We need the prudence of Joseph going forward over the next seven years and I intend to make sure that's the story we look to for our guidance," he said.

Indeed, despite the eye-popping income tax rates, the state's overall tax burden is not exceptionally high due to low property and business taxes. The effective business tax of 5.3 percent is only barely above the national average of 5.0 percent, according to an Ernst & Young report for the Council on State Taxation.

But some in the Brown coalition did appear to have more spending on their minds.

"We have the capacity to rebuild this state," said Dean Vogel, president of the California Teachers Association, which spent $32.8 million in support of Brown's tax hike and other ballot campaigns. He cited the need to address chronic underfunding for education and clean up the tax code - which could include closing tax loopholes.

PIONEERS IN POLITICAL INTRACTABILITY

California has historically been ahead of the nation in many things - including intractable partisan political warfare. Decades of extremism in both parties left little ground for compromise, and the state's constitution allowed the legislature's Republican minority, dominated by a conservative, no-taxes wing, to block any major change.

Deals made to pass budgets have created tortuous funding mechanisms and a welter of obtuse regulations, Democrats say.

Now, assuming the vote totals hold, Democrats, with two-thirds majorities in the state Senate and Assembly, will have the power to pass tax hikes or put constitutional amendments before voters on their own.

The Senate appears likely to have 28 Democrats, one more than needed to reach two-thirds, and the Assembly is on track to have 54 Democrats, exactly two-thirds.

That supposed ease of governing contrasts with the predicament of fellow Democrat Obama. His second term begins with a Democratic-controlled U.S. Senate and a Republican majority in the House of Representatives, the same divided Congress that thwarted his agenda in the last two years.

Liberal Democrats in California were already talking about new oil severance taxes, higher taxes on commercial real estate and the end of tax breaks in so-called enterprise zones.

At the edges of many conversations was the question of whether Democrats could or would change Proposition 13, the 1978 measure that keeps property taxes low and which voters approved when Brown won the second term of his first tour as governor. He was elected to a third term in 2010.

Prop 13 is still extremely popular, but some Democrats see room to chop away at its protections for business property while maintaining the core homeowner safeguard against rising property tax bills.

TAX CRAZY?

Republicans cautioned that any such efforts would be hazardous.

"The natural inclination for politicians is to over-interpret the mandate they've been given with an election like this one," said Dan Schnur, director of the Unruh Institute of Politics at the University of Southern California, and a former spokesman for Governor Pete Wilson, a Republican.

Still, voters broke from form in approving Brown's tax hike, and clearly support more spending on education. California ranks 47th of 50 states in per pupil education spending, and if the tax measure hadn't passed, $6 billion in additional education cuts would have been triggered.

Brown, ironically, may now emerge as the conservative force in discussions with the most liberal members of the legislature.

"The governor is going to see it as his mission to keep the brakes on anybody going crazy with the money," said labor union lobbyist Barry Broad.

Moderate Republicans might be more open to join the conversation with Democrats, since it was the only way for them to be relevant, added analyst Scott Lay, a lobbyist for state community colleges.

But the supermajority gives the legislature room to ignore Brown as well - or at least override his vetoes. That's likely to put in check some of the governor's ambitions, such as a second overhaul of public pensions.

"If I'm a Democratic leader of the legislature, I'm not waking up this morning thinking 'Boy, I've got to go after public pensions,'" said Jack Pitney, professor of government at Claremont McKenna College.

Brown himself sidestepped the issue of vetoes at a news conference. "This is about celebrations, not about drawing lines in the sand," he said.

MDS?s take: The 5-3 Colts have an easy enough schedule the rest of the way that if they just win the games they should win, they?ll finish the season with a winning record. One of the games they should win is this one, and I think they will.

Florio?s take:? The last time the Colts visited Jacksonville, a win by the home team ensured that Andrew Luck would head to Indy.? The Colts return as a playoff contender, intent on avenging a September home loss to the Jaguars.

MDS?s take: For a 6-2 team, the Ravens have a lot of question marks, especially on their aged and injured defense. But the Raiders have even more problems on defense, and I like Baltimore to win a high-scoring game.

Florio?s take:? The Raiders aren?t as bad as you?d think, and the Ravens aren?t as good.? Look for Baltimore?s decimated run defense to thrive against Oakland?s decimated running game, and for the Ravens to do enough to fend off the Steelers as a pair of games against Pittsburgh loom on the schedule.

Broncos at Panthers

MDS?s take: Broncos coach John Fox will win back at his old stomping grounds in Carolina, where Peyton Manning will pick apart the Panthers? defense while Von Miller will make Cam Newton?s life miserable.

Florio?s take:? John Fox returns to Charlotte with a quarterback far better than any he ever had when he coached the Panthers.? Against a team with plenty of guys Fox knows very well.? The Carolina winning streak ends at one.

MDS?s take: I could pick this game with confidence if I knew which Giants team was going to show up. Will it be the team that showed up for 60 minutes and pounded the 49ers, or the team that sleepwalked through long stretches of close wins against the Redskins and Cowboys, and a close loss to the Steelers? Given the way the Giants have played the last three weeks I?m tempted to go with the upset, but the Bengals? defense has been so bad this season that Eli Manning simply has to have a good game.

MDS?s pick: Giants 29, Bengals 25.

Florio?s take:? The Bengals are in a free fall, and the Giants are caught in the early stages of their annual midseason swoon.? I?ve got more faith in the Giants getting it done, especially since Eli Manning will surely have the benefit of some insights from his big brother, who won four days ago in Cincinnati.

Titans at Dolphins

MDS?s take: The Dolphins missed a golden opportunity to establish themselves as the AFC wild-card frontrunners on Sunday against the Colts, but I still like the way this team is playing, especially on defense. The Titans got a tongue-lashing from their owner after another bad loss on Sunday against the Bears, but that won?t be enough to shake them out of their doldrums.

Florio?s take:? Jake Locker returns, his left shoulder coincidentally healing at the time Matt Hasselbeck lost his hot hand.? Locker will learn what everyone else has learned this year.? The Miami defense is pretty good.

MDS?s take: When these teams met in Week Four in Detroit, the Vikings were bolstered by two kick return touchdowns and won 20-13. But the Lions have shored up their special teams problems, Vikings kickoff returner Percy Harvin is hurt, and the Lions should earn their first NFC North victory of the season in the rematch in Minnesota.

MDS?s pick: Lions 23, Vikings 10.

Florio?s take:? With a brutal post-bye schedule, this game could determine whether the Vikings will finish 6-10 or 5-11.? I?ll pick the Vikings now, primarily because it?s the last time I?ll pick them all season.

Bills at Patriots

MDS?s take: In another rematch of a Week Four meeting, the Bills? defense is in big trouble.? It probably won?t get quite as ugly for Buffalo as it did in the Patriots? 52-28 win in September, but the Patriots will put plenty of points on the board.

MDS?s pick: Patriots 38, Bills 20.

Florio?s take:? The Pats scored 45 points against the Rams in 60 minutes, and 45 against the Bills in 25.? New England needs to keep its foot on the gas in order to get ready for some tough challenges that are waiting in the postseason.

Florio?s pick:? Patriots 38, Bills 21.

Falcons at Saints

MDS?s take: The Saints have won three out of four, and a win here would signal that New Orleans really has turned its season around. Unfortunately, there are just too many holes on the Saints? defense for New Orleans to stop a Falcons team that can attack with Matt Ryan, Roddy White, Julio Jones, Tony Gonzalez, Michael Turner and Jacquizz Rodgers. This Falcons team just has too many weapons.

MDS?s pick: Falcons 27, Saints 21.

Florio?s take:? Halfway to an unblemished regular season, the Falcons simply don?t have the feel of a 16-0 team.? With four games against the Saints and Bucs over the balance of the year, the Falcons most likely won?t be.? It starts now, with the Saints staking their claim for a wild-card berth by hanging loss No. 1 on Atlanta.

Florio?s pick:? Saints 28, Falcons 27.

Chargers at Buccaneers

MDS?s take: With running back Doug Martin and a solid front seven on defense, the Bucs are becoming exactly the kind of team Greg Schiano wanted to build: A team that wins by running and stopping the run. Tampa Bay will do it again against a Chargers team that has yet to beat a good opponent all season.

MDS?s pick: Buccaneers 16, Chargers 14.

Florio?s take:? By playing last Thursday, the Chargers had some extra time to figure out how to stop the Muscle Hamster.? It won?t be enough.

MDS?s take: Seattle is a tough team to play for anyone, but I see Jets quarterback Mark Sanchez and his receiving corps having a particularly tough game against a good Seahawks secondary. Rex Ryan will have a good game plan to contain Seahawks quarterback Russell Wilson, but the Seahawks? defense will lead the way to a low-scoring win.

Florio?s take:? The Pete Carroll-Mark Sanchez reunion provides a great story line.? But the bottom line is that it?s foolish to pick against the Seahawks at home.

MDS?s take: Until Monday night, I was still a believer in the Eagles? ability to turn their season around. But Philly?s offensive line looked terrible, the defense looked like it has taken a step backward with the departure of coordinator Juan Castillo, and the Eagles look like they?re ready to pack it in for the season. The Cowboys may still make a run at the playoffs, but the Eagles are done.

MDS?s pick: Cowboys 24, Eagles 14.

Florio?s take:? It?s a early playoff game between two teams that are destined to miss the playoffs.? In the past two weeks, the Cowboys gave the Falcons a much better game in Atlanta than the Eagles gave the Falcons at home.

Rams at 49ers

MDS?s take: The 49ers? defense has had a few letdowns, but when they?re on their game it?s just about impossible to score on them. And they?ll be on their game against a mediocre Rams offense.

Florio?s take:? Lost in the success of the Falcons and the Bears, the resurgence of the Packers, and the collapse of the Eagles, the Niners are ready to remind everyone that they may be the best team in the conference.

Former Intel CEO Drives Education Reform in Arizona

Intel has been among the most critical tech companies in the U.S. that have consistently and strongly criticized the U.S. education system.

The company has immersed itself into the discussion by privately funding specific education branches, institutions and projects for more than a decade.

Craig Barrett, former chief executive offer and chairman of the board, has long led the charge to impact education and continues even after his retirement to change the existing education structure. Barrett, who stepped down from his career at Intel in 2009, was appointed chairman of the Arizona Ready Education Council.

During a recent discussion, Barrett discussed the recently implemented Common Core Standards for math and English, which he described as "the biggest transformation of K-12 education" in Arizona history. The approach is based on an international benchmark system to find out how U.S. kids have to perform to be competitive and integrate those findings in the curriculum. According to Barrett, U.S. kids are "kind of mediocre in reading, [and] below average in mathematics and science."

Barrett also believes that a portion of salary increases for teachers needs to be performance-based. To accomplish that he suggested a performance monitoring system that tracks kids and how their performance increases over a certain period.

Attorneys often take common expressions for granted, but a recent decision in the United States Bankruptcy Court for the Southern District of Indiana reminds us to pay close attention to how to express the foundation for the facts asserted in supporting affidavits and declarations.

In Fredin Bros., Inc. v. Bankers Bank (In re Eastern Livestock Co.), Peoples Bank sought a determination that it was entitled to certain funds paid into the court by Fredin Brothers, Inc.? The dispute arose from a transaction in which Eastern Livestock bought 192 steers from Kansas farmers who were, in turn, financed by Peoples Bank.? To pay for the cattle, Eastern wrote a check to the farmers and Peoples Bank, which check was subsequently dishonored.? Meanwhile, Eastern had sold the steers to a third party, which sold the steers to Fredin Brothers, which then sold the cattle down the supply chain to other purchasers.? Fredin Brothers, which had not yet paid for the cattle, then filed an interpleader action so as to avoid having to pay twice for the same cattle.

Once the interpleader suit was removed and transferred to the Indiana bankruptcy court, Peoples Bank filed a motion for summary judgment seeking a determination that it was entitled to the funds paid into the court by Fredin Brothers in connection with the interpleader action.? Along with its motion for summary judgment, Peoples Bank included a sworn and notarized verification from its president (which was, pursuant to for 28 U.S.C. ??1746, akin to a stand-alone affidavit or declaration).? That sworn statement included a qualifier that the facts alleged in the motion were ?true and correct to the best of my knowledge.?? In opposing the bank?s motion, the chapter 11 trustee for Eastern Livestock argued (among other things), that the presence of this caveat demonstrated that the bank?s president would not be qualified to testify to these facts or to introduce the supporting materials at trial and that the motion must be denied because it failed to satisfy the requirement, pursuant to Rule 56 of the Federal Rules of Civil Procedure, that any sworn declaration or affidavit (or, in this case, verified complaint) must demonstrate that the declarant is competent to testify to the matters stated therein.

In support of its argument that the bank president?s verified statement should be disregarded, the Eastern Livestock trustee relied on the Seventh Circuit Court of Appeals? decision in Price v. Rochford, in which the circuit court held that a litigant?s verification ?based upon his own personal knowledge or upon his information and belief? did not suffice to show that the affiant could testify to the matters stated in his sworn statement.? Similarly, the trustee contended that ?to the best of my knowledge? was too great a qualifier on the sworn testimony.

Though the bankruptcy court ultimately denied the bank?s motion for summary judgment on other grounds, it rejected the trustee?s argument that ?to the best of my knowledge? invalidated the sworn statement from the bank?s president.? The court noted that it was not a ?subjunctive escape clause? like the language at issue in Price, and the qualifier did not suggest that the statement was based on secondhand information.? The court, citing Visser v. Packer Eng?g Assocs., wisely noted that ?all knowledge is inferential? and that the apparent caveat in the sworn statement was accordingly ?of no moment.?? Even though ?upon information and belief or upon personal knowledge? would not run afoul of Bankruptcy Rule 7056, ?to the best of my knowledge? was considered adequate evidence of competency to testify to the facts set forth in the sworn statement.

It is easy to ignore the jargon that so often crops up in legal writing, but attorneys and putative witnesses would be well-advised to consider their words wisely.? Though it can be tempting to include caveats to protect ourselves and our witnesses from making false statements under oath, Eastern Livestock reminds us that these hedges have real meaning, and should be considered carefully.

And that?s no bull.

Bankruptcy Rule 7056 provides that Rule 56 of the Federal Rules of Civil Procedure applies in adversary proceedings in bankruptcy court. In turn, Federal Rule 56 provides that ?[a]n affidavit or declaration used to support or oppose a motion must be made on personal knowledge, set out facts that would be admissible in evidence, and show that the affiant or declarant is competent to testify on the matters stated.? Big Apple improvises to reopen for business

NEW YORK (AP) ? Two days after Superstorm Sandy brought business in New York City to a standstill, stores that lost power are again serving customers, albeit by flashlight. Companies with closed offices are setting up shop in coffeehouses. And the owner of the Skylight Diner is borrowing bacon from his neighbors because the restaurant's cupboard is bare.

The world's financial center is struggling to get back to work as it deals with a subway system that's still crippled by the worst damage in its 108-year-history and power outages in major sections of the city. That's kept both employees and customers at bay. As a result, big multinational banks are in the same proverbial boat as corner bodegas: looking for creative ways to get their businesses back up and running.

New York City is home to roughly a million companies of all sizes. While the impact of Sandy varies, the city's businesses face billions of dollars in damages and lost sales. So while reopening quickly is a priority, it can require resourcefulness and a smidge of creativity.

For Teddy Papaioannou, that meant calling in some favors. On Wednesday, the co-owner of the Skylight Diner was running low on supplies at his restaurant in the midtown section of the Manhattan borough, so he borrowed a few pounds of bacon from his neighbors who also are restaurant owners.

Papaioannou and his brother and father, who all own the diner jointly, were so eager to open that the three of them even chauffeured employees around on Tuesday and Wednesday. They picked up a total of 20 workers for various shifts over the two-day period.

"Closing for three days would ruin us for a month," he said.

Lost sales were a big motivator for other business owners too. William Badie, owner of Food Fair food market and deli, estimated he lost $8,000 because the store was closed on Monday and Tuesday. So he made sure he was open Wednesday. Only one of his usual three staffers could make it into work, so he paid for him to get there.

The 40-minute cab ride into Manhattan from the Queens borough typically costs about $35, which wasn't a huge cost, he figured, especially considering that he expected to make about $1,500 on Wednesday. But by afternoon, only two customers were eating lunch at a small table and another man bought a turkey sandwich. Still, Badie said he's fortunate because he never lost power and didn't have to throw away anything.

"It's very slow. There are no customers," he said. "But business is like that. You lose or you make. You can complain, but who is going to listen to you?"

In the lower section of Manhattan, where a massive power outage persisted, things got even trickier for businesses that wanted to reopen. Most stores were closed, but a few found a way to get customers.

Bareburger in the trendy Chelsea neighborhood in lower Manhattan was grilling burgers outside and giving them away, asking only for donations for the Red Cross. The restaurant, which has been in the neighborhood for a year, has lost several thousand dollars a day since losing power Monday. Workers iced down the restaurant's meat, but decided to grill after they realized it wouldn't be safe to eat after Wednesday.

Meanwhile, Deli & Grocery Corp. was open for business, just two doors down from a building whose facade had completely shorn off, making the exposed rooms appear like an open dollhouse, with decorated with beds, lights and furniture. The deli didn't have power, but a gas range was working so it was able to sell coffee, sodas and canned goods. Manager Tariq Mohamed Ali used a flashlight to see what he was doing.

Ali declined to estimate how much in sales the deli has lost, but he acknowledged that he really needs the subways to start running again and the electricity to come back so that customers can return. Otherwise, the deli may not be able to make its rent for the month. Still, he insisted that he opened so that neighbors would have a place to go.

"It's cold outside, so we wanted to give people coffee," he said. "If you do something nice it will come back to you."

For many of New York's technology companies and banks, the difference between opening or closing is not as clear cut as it would be for a grocery store or restaurant. Getting ? or staying ? open has been a matter of complex planning so that employees can work remotely.

Employees at Foursquare Inc., a social network that lets people tell friends and family where they are, were working from their homes or nearby coffee shops on Wednesday.

Though Foursquare encouraged people to work from home, the company also found space for about 70 people in Manhattan and some in the trendy Williamsburg section of the Brooklyn borough. There, regular tenants at a co-working space called Secret Clubhouse were joined by stranded employees not only from Foursquare but the gossip blog Gawker and the photo blogging site Tumblr, among others.

Meanwhile, financial giants such as Citigroup, Goldman Sachs and Morgan Stanley ? all with operations in the evacuated zone in downtown Manhattan ? were able to keep open by shifting work to offices in other areas of the city and neighboring states. Goldman Sachs said essential employees in the city were being shuttled to its headquarters in the Financial District, which a spokesman said suffered "minimal damage." Others were working in the company's backup offices in Connecticut and New Jersey.

Bank of America reopened its office in midtown Manhattan, but two offices downtown remained closed because they were in an evacuation zone. The bank also told employees who work elsewhere in lower Manhattan to work from home if possible.

"There will be a lot of cleanup in lower Manhattan," said bank spokesman Mark Pipitone. "And it's good to let the crews get their work done without the additional challenge of a few thousand more people moving through the area."

T-Mobile has already made an odd pair of decisions around its approach to the Nexus 4, namely its choices to ask $200 on contract and $500 up-front for a smartphone that costs $349 unlocked. It might be time to add a third quirk to the list, if a forgivable (and not entirely surprising) one. The carrier has confirmed to TmoNews that it won't be offering WiFi calling through its edition of Google's flagship; if cost or coverage makes cellular voice a scarce resource, VoIP might be the only viable backup. We weren't assuming that T-Mobile would suddenly layer the Nexus 4 in custom features when the very point is to run an unspoiled Android 4.2, but the strategy leaves us even less of an incentive to submit to long-term commitments when a virtually identical, unfettered Google Play model beckons. November 13th is looking better every day.
